BIHAĆ – Unsko-sanski kanton prvi je u Federaciji Bosne i Hercegovine po broju provedenih presuda – alternativne krivične sankcije rad za opće dobro na slobodi kojom je osuđenicima uobičajena zatvorska kazna do jedne godine zamijenjena ovom alternativnom krivičnom sankcijom. Od početka implementacije u krivičnom zakonodavstvu, u posljednjih deset godina obrađeno je oko 530 presuda, od čega u protekloj godini 75 presuda.

U krivičnom zakonodavstvu od implementacije 2011. godine, Ministarstvo pravosuđa i uprave izradilo je a Vlada USK-a usvojila Pravilnik o izvršenju alternativne krivične sankcije rad za opće dobro na slobodi koja je zamjena za izrečenu kaznu zatvora koju Sud može izreći i izriče kada za pojedino krivično djelo u konkretnom predmetu izrekne kaznu zatvora do jedne godine. Samo u tom slučaju se zatvorska kazna može zamijeniti radom za opće dobro na slobodi, kaže Dragan Polimanac, pomoćnik ministrice pravosuđa i uprave te dodaje kako je Unsko-sanski kanton od početka implementacije od 2011. godine prvi u Federaciji Bosne i Hercegovine po broju provedenih presuda.
-Mi sad imamo negdje blizu 530 zaprimljenih i obrađenih presuda od same implementacije, a od tog broja je u odnosu na ovaj izvještaj za 2020. godinu 75 presuda u toku prošle kalendarske godine zaprimljeno u ovom ministarstvu i obrađeno, kaže Dragan Polimanac, pomoćnik ministrice pravosuđa i uprave. U vrijeme kad je ova informacija resornog ministarstva podnijeta Vladi USK-a radi upućivanja u skupštinsku proceduru, od ukupno zaprimljenih sedamdeset i pet presuda bile su izvršene trideset i tri presude, zbog vremena zaprimanja i ispunjenja određenih procedura. Ministarstvo mora ovlastiti državnog službenika da alternativnu krivičnu sankciju provodi, od poslodavca kod kojeg se izvršava rad za opće dobro na slobodi dobiti prijedlog povjerenika koji će obavljati nadzor nad provođenjem.
U trenutku kada razgovaramo o tih sedamdeset i pet presuda, izvršeno je skoro osamdeset posto. One koje nisu, neće niti biti. U jedanaest slučajeva smo predložili nadležnom sudu da se izrečena kazna zatvora ipak izvrši zbog nemogućnosti izvršenja alternativne sankcije.
Za izdržavanje kazne, alternativne krivične sankcije rad za opće dobro na slobodi, Ministarstvo pravosuđa je potpisalo ugovore s poslodavcima, uglavnom komunalnim poduzećima u kantonu, ali i ŠPD „Unsko-sanske šume“, Kantonalnom bolnicom „Dr. Irfan Ljubijankić“ kod kojih radi određeni broj osuđenika. -Poslodavac koji im omogućuje izvršenje rada za opće dobro na slobodi unutar svojih radnih jedinica ima jedino obavezu da ta lica osigura od povrede na radu. To je jedina obaveza koju poslodavac ima i to se provodi bez ikakvih zastoja. Nikakvu drugu financijsku obavezu poslodavac nema, kaže pomoćnik ministrice Dragan Polimanac. Od početka ove godine Ministarstvo pravosuđa je zaprimilo petnaest presuda. Naš sugovornik ističe kako od početka primjene ove krivične sankcije nije bilo nikakvih proceduralnih problema. Rad za opće dobro na slobodi ne može trajati duže od jedne godine a niti godinu. On se izriče u trajanju ne kraćem od deset i ne dužem od devedeset dana. Na ovaj način osuđenici – počinioci krivičnih djela društvu moraju vratiti svoj dug. Samir TULIĆ
